MEDIATIONS, ARBITRATIONS & CASE EVALUATIONS

Having spent much of my life representing individuals and businesses in lawsuits, trying their cases and doing appellate work, it has become obvious that working towards a mediated settlement is the best move any litigant can make.  A mediation process, where the position of each side is challenged, where each side is encouraged to acknowledge what they are likely to achieve at trial - as well as the costs of winning, losing, appealing (or defending an appeal) and collecting a judgment - is often the only way for the parties to find a compromise that ends the fighting,  ensures payment, while avoiding continued uncertainty and ongoing expense.  

I also provide arbitrator services for both binding and non-binding arbitrations.  Arbitration will provide a quick and efficient resolution of most lawsuits either before or after they are filed.  Binding arbitration produces a reasoned award, supported by law that, with few exceptions, ends the dispute with no uncertainty of appeals.  Non-binding arbitrations provide a streamlined process for obtaining a neutral decision based on the law and facts, promote settlement and resolve a case without trial with the potential for a fee award against a party who rejects the decision and choses to proceed to trial.

For cases that I will not be asked to mediate or arbitrate, I offer my experience and to help attorneys evaluate and explore litigation strategy, pleading claims and defenses, formulate discovery plans, effective deposition techniques, jury selection and trial preparation.
